最近,陆续有卖家咨询自己的亚马逊账号因为DMCA(反通知)而被封号的情况:

Your Amazon seller account has been deactivated in accordance with section 3 of Amazon's Business Solutions Agreement. Your listings have been removed.

We took this measure due to incorrectly using the DMCA counter-notice process . This is a violation of Amazon’s Seller Policies and Seller Code of Conduct:

首先,我们先来了解下什么是反通知?
进行反通知时我们需要注意以下几点:
1.DMCA 反通知仅适用于在美国收到的版权声明;
2.认为投诉的内容并不侵权;
3.声明需要真实,无任何修改,并承担相应的法律责任;
而根据最近几个此类型的case沟通后得到得细节,卖家在进行反通知前,先对申诉的listing(asin)内容进行了修改,再提交DMCA(反通知),这一行为,被亚马逊判定不正确地使用了DMCA反通知程序。
DMCA反通知是认为投诉的内容并不侵权,所以是无需进行任何修改的;反之,如果需要进行修改,那就只能承认侵权进行正规申诉。
还有另一种是被判了行为准则,根据客户内部查因出来的结果是使用DMCA反通知程序欺诈:

从内部查因结果备注:审核出该卖家无权销售这些产品,并且冒用DMCA反通知避免移除ASIN, 指出:没有法律批准不得回复。
申诉:必须走法律程序或者由权利人发给亚马逊的撤诉信,不然拒绝。
